Police files charge sheet against Salman

Three weeks after Salman Khan was arrested in a hit-and-run case, the Mumbai police on Monday filed a charge sheet against him in a magistrate's court, which remanded him to further judicial custody till October 31.

Metropolitan Magistrate S Y Sisode rejected the actor's bail petition on the ground that he had no jurisdiction to grant bail.

The actor will once again move the sessions court in this regard.

The actor's lawyer, A Anand, urged for Salman's discharge on the grounds that the case did not fall under the purview of Section 304 (II) of the Indian Penal Code. The court will hear his plea on October 31.

Salman's father Salim and stepmother Helen were allowed to meet him outside the court for 15 minutes.

Also present were brother-in-law Atul Agnihotri, brother Arbaaz, and actors Puneet Issar and Kishen Kumar.

Salman was brought to the court from Thane jail. He had allegedly rammed his vehicle into a bakery on September 28 in suburban Bandra, killing one person and injuring four.

He has been charged with ten offences under the IPC, Motor Vehicles Act and Prohibition Act, punishable with jail terms ranging from one to ten years.

Under the IPC, he has been charged under sections 304 (II) (culpable homicide not amounting to murder), 279 (rash driving), 337 (act dangerous to lives of others) and 338 (causing grievous hurt to others).

Under the Motor Vehicles Act, he has been charged under sections 3 (driving without licence), 134 A (not rendering medical aid), 134 B (not informing police), 185 (drunken state) and 187 (rash driving).

The actor is also charged with offences under Section 66 (1) (b) of the Prohibition Act, which prohibits a person from driving after consuming alcohol.

With the filing of the charge sheet, decks have been cleared for Salman's bail, legal sources said. The actor is likely to move the sessions court in this regard today.

The actor's bail plea has been rejected thrice. Magistrate Sisode rejected his petition twice.

On October 16, a sessions court rejected his plea on the ground that an offence under 304 (II) was prima facie made out against the accused.
