Kishwar Jahan, mother of Rizwanur Rahman, on Tuesday prayed in the Calcutta High Court for criminal proceedings against former Kolkata police commissioner Prasun Mukherjee and another senior police officer.
CBI report must speak the truth: Rizwanur's mother
Kalyan Banerjee, lawyer for Kishwar Jahan, said that an appeal was filed during the day against Justice Dipankar Dutta's order, wherein no action was ordered against Mukherjee and the then deputy commissioner (headquarter) Gyanwant Singh.
The court had, however, criticised Mukherjee for his comments in a press conference with regard to Rizwan's death.
Banerjee claimed that these two officers could not escape responsibility in the case and that criminal proceedings should be drawn up against them.
Rizwanur death: Protest gathers momentum
Ashok Todi, father in-law of Rizwanur, and another relative Anil Saraogi, have also appealed against the order of August 14 that directed the Central Bureau of Investigation to chargesheet them along with some senior police officers.
Both the matters are likely to come up for hearing together on Wednesday before a division bench presided over by Chief Justice S S Nijjar.
What Rizwan's wife said 3 weeks before his death
Justice Dutta had directed the CBI to chargesheet industrialist Ashok Todi, his brother Pradip Todi, cousin Anil Saraogi, Rizwanur's family friend Pappu, besides the then deputy commissioner of police (detective department) Ajay Kumar, former assistant commissioner of police Sukanti Chakraborty and sub-inspector Krishnendu Das of the anti-rowdy section of the Detective Department.
Rizwanur, who was under tremendous pressure to separate from his legally married wife Priyanka Todi, daughter of Ashok Todi, allegedly at the instance of the police, was found dead beside rail tracks on September 21 last year.
The incident sparked off a furore with the High Court asking the CBI to conduct a probe into the cause of the youth's death.
The CBI submitted its report on February 28 to the court, stating that Rizwanur committed suicide.
